The loss of a loved one may be the most difficult experience a person ever has to experience. This loss becomes incrementally more difficult when it is sudden and unexpected. There are many situations that may lead to the sudden death of a loved one, including fatal accidents that occur as drivers are traveling on the roadways of California.
A recent accident that happened around 8 am on a foggy California morning involved three semis and two passenger vehicles. The accident resulted in three deaths. One semi was in a turning lane and visibility was so poor that the driver rolled down his window to listen for oncoming traffic. When he took the turn, a semi headed in the opposite direction hit the rear of the first semi as well as another car waiting at a stop sign. This caused the second semi to roll and spill its load of hay bails. A third semi swerved to miss the spillage and overturned big rig which, in turn, caused a head-on collision with an oncoming passenger vehicle. The driver and two passengers in that vehicle were fatally injured.
This accident is still under investigation and neither negligence nor fault has been determined. However, in a case similar to this one, there may be recovery available for the family of accident victims who were fatally injured in a multi-vehicle wreck.
When an individual is fatally injured in a car accident caused by another person’s negligence, the negligent party will be held liable for causation. This means that the loved ones of the deceased can file a wrongful death lawsuit against the negligent party to recover compensation. Although no amount of money can bring back a lost loved one, the compensation will help the family to deal with the sudden onset of financial obligations such as medical bills and death expenses. The family may also be able to recover some compensation for pain and suffering.
