Child killed in accident outside California middle school

Drivers traveling the roadways of California should always be on the lookout for pedestrians and bicycle riders. However, this is even more important in school zones where numerous children are present. These areas are often very busy shortly before and after school, and if drivers are not paying very close attention a pedestrian, bicycle rider or someone else may easily get injured.

In an incident that occurred recently in California, a young bicyclist was killed when he was struck by an SUV driven by the mother of another student. According to authorities, the accident occurred shortly before 8:00 in the morning. It was just before the first bell rang.

A witness to the accident reported that he saw the SUV strike the 12-year-old seventh grader. After striking the child the man said he saw the bike underneath the vehicle and he knew it was not going to be a good situation.

The seventh grader was reportedly riding his bike on the shoulder and against the flow of traffic when the mother driving the SUV took a right hand turn. It was upon making that turn that she struck the child. This fatal accident is truly tragic for all parties involved and the details are still under investigation by authorities.

Neither speed nor alcohol is believed to be a factor in the occurrence of this accident. However, that does not mean that other elements of negligence were not present. In a fatal accident, when a death is caused by another person’s negligence, the surviving loved ones may be able to recover compensation for the hardships they are experiencing due to their. Compensation can be sought by filing a wrongful death lawsuit against the negligent party. Compensation can cover medical expenses, funeral expenses and pain and suffering.
