Fatal accident possibly caused by defective airbag

When a family member or loved one dies as the result of a fatal accident, it is always devastating. What makes it worse is when the death was preventable. When a company intentionallycuts corners to save money or negligently puts a dangerous product into the market, that company needs to be held responsible for the injuries and deaths that result.

Recently, the federal government issued an urgent safety warning for more than 11 million cars with possibly faulty airbags, but the warning may have come too late for some, especially a 47-year-old Rosemead man. The man died in 2013, even though his airbag deployed, when his 2002 Acura hit three parked vehicles and a wall. An Alhambra police report stated that, “The air bag had a metallic portion that hit the deceased on the face as it deployed,” and the coroner’s death report also described a similar problem. During the same month in 2013, a Florida woman had a comparable airbag experience, and though severely injured, she lived to tell the tale.

The police report stating that the man was hit in the face by metal as the airbag deployed will be enormously valuable to the man’s family should they decide to bring a lawsuit against the car manufacturer. Police reports are part of the comprehensive investigation essential to prove who is at fault for a motor vehicle accident. The family could choose to bring a wrongful death action and recover compensation for their pain and suffering, loss of companionship, lost wages and medical and funeral costs. If the victim suffered pain while still conscious, a survival action is another type of lawsuit the family may want to consider to recover damages
