Recovering damages for wrongful death in California

For many decades after California became a state, it relied on the English common law to decide cases involving personal injury and death caused by the negligence of another person. Under the common law, the right to sue for damages was extinguished by the victim's death. As judges and legislators across the county began to appreciate the unfairness of this rule, statutes were passed to permit survivors to seek damages for what came to be called "wrongful death."

Toyota sued in case alleging uncontrolled acceleration

A recently-filed lawsuit in Los Angeles Superior Court may be the first of several against Toyota Motor Corporation alleging that sudden uncontrolled acceleration of a Toyota vehicle caused an accident that killed five people. A second such suit arising out of the same car accident has been filed in San Bernardino County.

Ex-track star causes 5-vehicle crash in Van Nuys

Most media reports of traffic accidents end with the statement that police are still investigating the cause of the crash, and few specific details of the accident are reported. A recent collision in Van Nuys was caught on a security video camera, and police were able to provide what amounts to a play-by-play description of what became a multi-vehicle car accident.

Street racing a dangerous risk to other motorists and spectators

Last week, this blog described the tragic sequence of events that began with a freeway car race and ended with the deaths of three people. One of the racing drivers has been charged with three counts of murder, and, if convicted, he could be sentenced to life in prison. The other driver is still at large. This accident has once again called attention to an increasing and hazardous phenomenon: street racing on Los Angeles' streets and freeways.
