Previous postings in this blog have discussed the potential danger of accidents involving commercial motor vehicles. This danger presents itself due to the size of these vehicles and the sometimes hazardous nature of the materials they carry. Passenger vehicles are simply no match for such a large commercial vehicle. The unexpected loss of a loved one, as this young woman’s family is surely dealing with at this time, can be one of the most difficult experiences a person will ever have to deal with. Although nothing will bring back the lost loved one, there is sometimes a small amount of solace possible in the recovery of damages from the responsible party.
These damages are recoverable if the loved one’s death was caused by the negligence of another individual or party that was involved in the accident. For example, in this case, if it is determined that the truck driver was negligent and therefore caused the collision with the bicyclist, the survivors of the bicyclist may be able to recover compensation from the truck driver or his employer by filing a wrongful death lawsuit.
